San Diego Car Accident Kills Sheriff’s Deputy

Deputy Ken Collier, 39, was fatally injured in a San Diego car crash while pursuing an alleged drunk driver on CA 52. According to the LA Times Blog, the pursuit started after the deputy spotted a wrong way driver coming toward him on the same side of the highway. Collier made a U-turn to pursue the driver but crashed into a bridge abutment in the process. Collier was transported to a hospital where he died shortly after the car crash.

The suspect, Jose Jasso Lopez, 22, was apprehended by CHP and the Sheriff’s Department moments after the crash. He was arrested on suspicion of driving under the Influence and vehicular manslaughter.

If this news story is accurate, Lopez could face serious criminal charges. According to California Vehicle Code Section 23152 (a): “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

Anyone under the influence of alcohol should not be operating a vehicle. Driving under the influence is not only dangerous but against the law. Anyone with a blood alcohol level of 0.08 percent or higher is prohibited by law to operate a vehicle.

Fatal Oxnard Car Collision Caused By Drunk Driver

Two local DJs Alex Estrada and David Garcia were fatally injured in a DUI collision on the night of September 27. According to a news article in the Ventura County Star, The two friends were heading home from a gig when a drunk driver crashed into their car. The accident killed the two DJs and seriously injured Garcia’s wife.

I offer my deepest sympathies to the friends and family of Alex Estrada and David Garcia. I hope that David Garcia’s wife makes a full recovery. Please keep them in your thoughts and prayers.

Accident Kills Two In DUI Car Collision

Lynette Ann Hunt, 32, was sentenced for the death of her two friends who were killed in a DUI car collision on July 11, 2008. According to The Orange County Register, Hunt and her two friends were celebrating a birthday in Santa Ana at a gentlemen’s club. After the celebration Hunt got behind the wheel of her 1993 Honda sedan accompanied by her two companions. According to eye witnesses Hunt was seen on the 91 freeway weaving in and out of lanes before losing control and flipping her car down an embankment. The car rolled over ejecting Hunt and one of her passengers Maria Zamarripa. Both passengers suffered fatal injuries. Hunt suffered a broken clavicle and broken ribs.

Hunt pleaded guilty in August 2009 to felony vehicular manslaughter while intoxicated, misdemeanor driving on a suspended license, and sentencing enhancements for causing great bodily injury and having a blood-alcohol level of .15 percent. She has been sentenced to six years in prison.

DWI case, should I represent myself or hire a lawyer?

Got a DWI, I didn’t blow! They couldn’t get blood! I look good on video! I’m in the Military, would it be stupid to represent myself ?!? or should I hire a dwi lawyer which will cost me $ 5,000 instead?
Yes, I refused! and what do u mean I don’t need one since it’s my 1st offense?! I live in Houston TX.

Did you not blow because you refused? If so, you are automatically charged with DUI, highest rate of alcohol. If it’s you first offense, there really is no need for a lawyer.
I mean that there are guidelines that must be followed for DUI. (at least in PA) The first offense is basically a slap on the wrist. I got ARD which is for first-time offenders. Basically it is no jail time, probation and it get’s espunged off of my record in one year….as long as I stay out of trouble. This is also if you were not in an accident. Anyway, you refused so you have a whole different set of things to deal with. Bend over and call the lawyer! They will be harder on you for being difficult. I don’t understand why people refuse?! Not only do you make it harder on yourself for being uncooperative, but you also get charged with DUI-HIGHEST RATE OF ALCOHOL!! That means that even if you had not drank a single sip- you would still be charged as if you were very drunk! It makes no sense to me!!

2nd DUI arrest but didn’t blow?

I got a 2nd dui arrest; the first time it was brought down to wreckless driving.

This time I was not drunk, but my breath smelled like alcohol, and even though I passed the sobriety test I was still arrested. Later I refused to take the breathalyzer. What are my chances of winning this case and is it possible to get my license back if I get a drunk driving lawyer?

Your chances of getting your license back and beating the charges are good. Evidence against you is the smell of alcohol and refusal to take the breath test. Evidence in your favor (especially if it was recorded) is you passed the field test. Also, the police have to had a reason to pull you over. You will have to take the case to a jury trial. If you go before a judge only, they probably will find you guilty. You will need a good attorney. A good attorney will cost a lot. It’s well worth the money depending on the circumstances. I recommend one that specializes in DUI cases. A good way to find an expert attorney in any case is to ask someone affiliated with the courts and the local police.
I recommend you use the following site to help you find a good attorney. It’s a great site that rates lawyers and gives you info on what they specialize in. It’s relatively easy to use but just because an attorney is not listed in the site does not make them a bad attorney.
