My son is still in high school and is 18 and got a DWI?

December 14th, 2009

Need to clarify, My son is a good kid. He made a terrible, stupid mistake. He really is a good kid. He is still in High School (because I held him back a year) and he runs cross country track and colleges are interested in him coming to their schools and he has never taken drugs and goes to Church without being told. But yes, he got a dwi on New Years and what I really want to know, is having a Lawyer going to make fines or jail time better than having a public defender?

DWI news anchor asks for money, support. No tears for victim

December 10th, 2009

Go to myspace.com/ncproud for more about Casey Bokhoven

WXII Tolly Carr speaks at church about the preliminary dwi accident report.

Tolly Carr’s lawyer, David Freedman, presented the media with a DVD containing video of Carr speaking at Greater Cleveland Avenue Christian, a local Winston-Salem church, just a week (Sunday, March 18, 2007) after the fatal accident. Carr appeared to focus more on the affect his DWI accident had on his career and his own family than on the man whose life he took, Casey Bokhoven. He did not mention Bokhoven by name, but asked the church congregation to pray for the victim’s family.

Also, a preliminary accident report was released, with these details of the accident in which Tolly Carr was involved: Carr went through the work zone barricade at Burke and West First Street at around 50 mph in his Ford 150 pickup truck, preceded down West First Street, veered off the road, went over a small wall, hit Bokhoven at 30 mph as he was standing on the sidewalk, then drug him 22 feet before crashing into a building. Bokhoven died under Carr’s pickup truck.

Carr has been charged with DWI thus far, with more charges possible. Carr refused a Breathalizer test and was unable to perform simple field sobriety tests at the scene. Blood samples were taken and the results have not been released to the public as of this date. (March 25, 2007)

This was from Fox 8 WGHP 10 pm broadcast on Friday, March 23, 2007. WGHP is located in High Point, North Carolina.

I got a dwi in my parents car how can they avoid getting whiskey plates?

November 29th, 2009

I got a dwi in minnesota. I was driving my parents car. I blew a .20. I was told by the police officer and a lawyer that they would have to get whiskey plates even though they are not responsible. How can they avoid this? if there any websites that would have additional information on this specific issue, or a form they can fill out to repeal this?

If you drive that car it is a problem your parents have to deal with you were careless and did not think about what could happen.
You could have killed someone a whiskey plate will let others know the driver could careless about their lives.

I got a DWI Monday. I got a lawyer. But I feel terrible. How has one moved on with life with one?

November 25th, 2009

I am so depressed over it. I know I have a problem with alcohol now and I decided to try my best to quit drinking. Obviously I haven’t had a drink since then. This is a nightmare experience. I was going to go to college this spring, but now I’m probably not going because of this. Even though this is my first and last DWI. I am unemployed and I don’t know if anyone would hire me. I’ve had thoughts of suicide recently because of it, and I know that’s the easy way out but I won’t do it. I turn 25 in 6 days and I just can’t bring myself to do it. If you had any DWIs, tell me how you coped with this. I feel like absolute crap. I am worthless. Tell me how you moved on with your life. Go ahead and call me a drunk and all kinds of things, I don’t care, because I deserve every bit of it. I just need advice.
I should clarify:

No one was injured nor killed.

There was no property damage.

I blew a .15.

First off, get rid of the Lawyer. He is just going to cost you more money. States have mandatory punishments for DWIs and no Lawyer will change that. If you feel you need one get a Public Defender. A DWI is a misdemeanor. Not a huge deal. Most States just want your money and to inconvenience you. Suicide? Come on.
Here’s what you do. Find out from the Public Defeders Office exactly what your punishment will be. Do everything you can before you go to Court. Ask the Judge for an extension. Go to Driving School, do your Public Service, go to your Alcohol Counseling…everything you can possibly do before giving up your License. Ask for another extension if needed.
On the day you finally do go to Court you can give the Judge a Certificate of completion for these things then plead No Contest.
You will then have to pay your fine and turn in your License. Make sure you have an appointment at the DMV the next day so you can get a Hardship License. You may get probation but your Hardship License should cover you driving there.
It doesn’t sound like the DWI is making you suicidal, it sounds like the booze is.

How can I get my husband to stop drinking and drivig before he kills somebody.?

November 24th, 2009

My husband continues to drink and drive. He is not an attorney but knows the law inside and out. He has been arrested 3 times for D.W.I. ( Tennessee ). He acts as his own attorney and wins easily everytime.

He actually blames the cops. He says they just think that because they say somebody is drunk then the judge will believe them. He says they just 1/2 ass the whole arrest process because 95% of people plead guilty.

I am so angry. He knows every trick. He does not take field tests, answers no questions, and then goes to court and gets the damn things thrown out for some bullshit or even worse found not guilty.

I know a few times he was not falling down drunk but HE IS DRUNK. Should I just divorce him and pray he does not kill somebody ? He says if I divorce him he will get joint custody of the kids because the court will not hold the arrests against him since he was not convicted. I am SO mad. Speaking of Mad if anybody from MADD can help ???
Wow !! Thanks to everybody that gave me the answers I wanted to hear. Also in under 30 min. Thank you all. I am not going to chose a best answer because they are all best. I do think I will call the police but let them know they are dealing with a professional drunk that knows the system.

Maybe the police will cross every T and dot every I.

My father told me that he will take out a loan for up to 15,000 for attorney fees for the best there is out there if I will leave this drunk.

I am going to do this and I think everybody.

You have to accept that he is an alcoholic and that you can’t control his behavior.

I’m sorry but that’s the way it is.

My DUI Attorney Official Website Is Launching Soon

November 22nd, 2009

This website, my-dui-lawyer.com is just a newsfeed site, and the “real” and “proper” DUI resource website is on its way, and is scheduled to launch this week, probably right on Thanksgiving Day. The new site will be a directory and a resource for all those poor souls who have been pulled over and charged with a DUI, DWI, OAI, OWI, or whatever ackronym (sp) designates someone “driving under the influence of drugs, alcohol, or other medical conditions”. The URL of the new site is www.MyDUIattorney.org

On the new and upcoming website, people who are looking for drunk driving lawyers or DUI / DWI lawyers as they’re commonly called, will be able to quickly put in the state, county, and city of their DUI encounter and be immediately taken to a list of DUI attorneys that serve that particular area. Each attorney’s listing will have various important information, such as whether they offer a free initial consultation, do they accept monthly payment plans for their services, do they have specific DUI case experience (i.e. they’re not just a generic criminal lawyer but they have SPECIFIC experience in the area that you care about), and more.

In the spirit of providing as much information as possible, the my-dui-laywer.com website will also provide quite a bit of information about all aspects of DUI, including how chemical tests (breathalyzers), blood tests, and field sobriety tests work, the various laws that govern DWI / DUI arrests in every state in the United States, and a whole lot more. Of course, the average person who is charged with this crime probably won’t have much of an interest in researching all this info, but if the information helps them come to an informed decision and helps them to find a better-suited and more caring drunk driving attorney, then it has served it’s purpose.

Something important to note for attorneys wishing to join the directory… We are offering a FREE listing to any and all DUI lawyers that wish to be listed. The listing in our dwi directory is free until one of two things happens. Either the lawyer gets 2 confirmed leads where the client actually makes a sit down, in person consultation, comes in and completes the consult, or if 6 people fill out the “contact me” form on our site for a particular attorney and the information is valid. This way, as a DUI attorney, you only pay for results, not speculation. Once you’ve met either limit, the listing will cost approximately $299 a month, and we’re going to be featuring 2 types of listings - premium listings ($399 – larger ones) and regular listings (the $299 a month ones).

We don’t want to flood each state or city’s list of lawyers, so we’re going to limit the number of lawyers appearing on a particular page to 7. One will be a premium listing, at the top, and the other 6 will be regular listings. This limitation is specifically designed to ensure that your listing doesn’t get lost in a sea of competing DUI attorneys and you have a fair and good chance of getting substantial referrals and business from the website.

Again, look for our official launch this coming week, and thanks for stopping by the site!

My lawyer has put my dwi case off for almost a year. Whats his reasoning?

November 17th, 2009

Only he knows. Why not ask him? perhaps so you can attend treatment and/or a year of AA before the trial to help reduce your sentence.
