What was the sentence for your DWI in NJ?

Anyone got a DWI ticket in the state of NJ. If so, what was your punishment? (ie how many months of license loss, court fees, etc.). This is my forst offense and I already got a lawyer, but I’m juist trying to see what I should het ready for.

470 dollar fine , 1000 per year surcharges for 3 years , 2 day IRDC program——-everyone gets the same sentence lawyer or no lawyer

Who set the standards that consider someone an alcoholic?

Please do not give me the MADD stuff. I know an attorney that has represented some of these people on DWI cases. One of the members used the excuse that her son died in a wreck and that’s why she was drinking and driving. No excuse for people out of the cult, then no excuse for you.

If a person has to have a drink, they are alcoholic. If they drink in the mornings and during the day, they are probably alcoholic. If they cannot function in a normal manner or miss important meetings, they are probably alcoholic. If their blood alcohol level is 0.1, I believe it is, that is under the influence for driving. Don’t call that alcoholic, but under the influence of alcohol and to a degree that is a crime.

Sounds as though you are looking at under the influence. Some states may have different figures but most are 0.1, I believe. That can be affected by how much y ou eat and your body weight, etc. as well as how much you drink. It is not a certain number of drinks, though I believe 2 or 3 might do it.

How can I get my husband to stop drinking and drivig before he kills somebody.?

My husband continues to drink and drive. He is not an attorney but knows the law inside and out. He has been arrested 3 times for D.W.I. ( Tennessee ). He acts as his own attorney and wins easily everytime.

He actually blames the cops. He says they just think that because they say somebody is drunk then the judge will believe them. He says they just 1/2 ass the whole arrest process because 95% of people plead guilty.

I am so angry. He knows every trick. He does not take field tests, answers no questions, and then goes to court and gets the damn things thrown out for some bullshit or even worse found not guilty.

I know a few times he was not falling down drunk but HE IS DRUNK. Should I just divorce him and pray he does not kill somebody ? He says if I divorce him he will get joint custody of the kids because the court will not hold the arrests against him since he was not convicted. I am SO mad. Speaking of Mad if anybody from MADD can help ???
Wow !! Thanks to everybody that gave me the answers I wanted to hear. Also in under 30 min. Thank you all. I am not going to chose a best answer because they are all best. I do think I will call the police but let them know they are dealing with a professional drunk that knows the system.

Maybe the police will cross every T and dot every I.

My father told me that he will take out a loan for up to 15,000 for attorney fees for the best there is out there if I will leave this drunk.

I am going to do this and I think everybody.

You have to accept that he is an alcoholic and that you can’t control his behavior.

I’m sorry but that’s the way it is.

Should I report my lawyer for bad ethics? And do you think he will be reprimanded?

I had a DWI for an almost fatal motor vehicle accident. My lawyer knowingly withheld information from me, and chose not to represent me very well. Aparently, I said some things during my arrest that I had no knowledge of at the time. I think that I may have had temporary amnesia, because I now remember it. I know that I can report this lawyer, but I don’t want him to lose his job but I also do not want him to get off easy for this either.

You should report him. Contact the local bar association where he practices and file a grievance.
The attorney will likely be reprimanded, but it’s also unlikely he will lose his job. He could get a very short suspension, but there’s no reason to believe that he will lose his license to practice law and lose his job. If he withheld info from you and didn’t do his job, you should file the grievance.

LEGAL ADVICE! I’m 19 and got a DWI, do I need a lawyer? What costs and penalties am I looking at?

Last Sunday, after Halloween…

I got pulled over in the morning for speeding at 93. It was an extremely bad move on my part. I was drinking the night before and felt absolutely sober that morning. It didn’t even come across my mind that there was still alcohol in my system.

So I got pulled over, got breathalized, and blew 0.36. This is below the regular legal limit for those of age to drink..which is 0.8. I know that I’m not supposed to have ANY alcohol in my system. But I got my license suspended, given a temporary one for thirty days, and I have to respond to a hearing within 10 days (it’s like 6 days left now). My ticket says that I was driving with a BA of greater than 0.1.

I know that there should be different consequences for having a BA at over 0.5 and 0.8.. So I just want to know how badly I’m in a rut here. I understand it was stupid on my part, and I definitely should have waited it out that morning…but I had an anxious passenger that really wanted to go home..and I defnintely shouldn’t have been speeding.

I think I’m looking at about a 1 year license suspension and perhaps a $380 fine..but is there anything else I might get knocked down for? Jail time? How many hours of community service? What kinds of programs and how much? Should I attend the hearing since I’m pretty much guilty and there’s evidence of my fault?

My parents aren’t letting me drive even with the temporary license..so trying to get an extension on that isn’t going to change anything. I just want to know if I need a lawyer or not! THANKS SO MUCH! Apologies, I know I’m going to get a lot of heat for speeding with alcohol in my system..
I’m sorry I blew 0.036, and the legal limit is .08. I went to a legal clinic at my University and they said that I probably wouldn’t need an attorney unless I’m looking to get out of it. There’s basically a standard bracket of fines for underage DWIs but I believe that is variable depending on my driving history. For the first offense, I’m not looking at jail time or community service, but I’m not entirely accurate about what the attorney said here.

I was pretty convinced that I didn’t need an attorney, but I’m getting a whole lot of second opinions here that I should hire one. It seems to add more to the bill since I’d have to plea guilty anyway. So really, is it financially worth it to hire one since the penalties are pretty much what I’m going to haev to deal with?

Yes. You definitely need an Attorney.

I recommend that you interview at least 3 or 4 Attorneys who have a great deal of experience defending DUI cases.

Ask them about their recent cases and what were the results.

Hire the Attorney that you think is best for you.

The breathalyzer is a notoriously inacccurate device. The results of a breathalizer are often 50% higher than true blood alcohol levels.

Also there have been cases where breathalyzers registerd a positive reading in subjects that had absolutely no alcohol in their system.

You really need to hire a good experienced Attorney to represent you.

How good are public defenders in minimizing or dropping drug and DWI charges in New Jersey?

I am being charged with DWI and posession of drugs inside of a vehicle. I am in a really tight situation and am considering just getting a public defender becuase i cannot afford a lawyer. At the preliminary they told me i prob could qualify for a public defender, but all of my friends are highly advising against it. They say that public defenders dont fight for you and that they dont care. They just work for the state and cater to the prosecuters interests more than to yours. Is this true?

Yes.

Public defenders don’t usually put very much effort into their work, and will encourage you to go along with the prosecuter in order to shift the case through as rapidly as they can. There are probably exceptions but I’ve only seen them on television shows.

My DUI Attorney Official Website Is Launching Soon

This website, my-dui-lawyer.com is just a newsfeed site, and the “real” and “proper” DUI resource website is on its way, and is scheduled to launch this week, probably right on Thanksgiving Day. The new site will be a directory and a resource for all those poor souls who have been pulled over and charged with a DUI, DWI, OAI, OWI, or whatever ackronym (sp) designates someone “driving under the influence of drugs, alcohol, or other medical conditions”. On the new and upcoming website, people who are looking for drunk driving lawyers or DUI / DWI lawyers as they’re commonly called, will be able to quickly put in the state, county, and city of their DUI encounter and be immediately taken to a list of DUI attorneys that serve that particular area. Each attorney’s listing will have various important information, such as whether they offer a free initial consultation, do they accept monthly payment plans for their services, do they have specific DUI case experience (i.e. they’re not just a generic criminal lawyer but they have SPECIFIC experience in the area that you care about), and more.
