Legal Solutions – Married To A Criminal Lawyer

A woman calls saying her wedding was in 2006 and after 6 months she called her husband over to the UK. After 1 year, 4 months she found out when going India, with the holidays booked, her husband said he didn’t want to go India as his passport was inbounded with a criminal charge from India. When he renewed his passport, he didn’t declare this. He received this information notice to his house but he didn’t show it to her all these years. So we had arguments, to which Harjap says they were bound to happen. After 2 months, he went to India and came back and said everything is clear. I decided I didn’t want to stay with this criminal and applied for a divorce. After this, he caused problems and I didn’t know his whereabouts. He was a solicitor, working in Croydon but he never told his address. She continues by saying she got his address from his Uncle and sent divorce letters to India and his employers. He didn’t acknowledge the divorce application and the judge gave him 7 days. He then replied saying he wanted to defend the divorce, saying it was unreasonable. He sent a long letter to the judge and asked for the marriage to be resolved and another opportunity. She said she don’t want to live with him and the problem is that his visa is has finished. She then realised that he got a student visa from somewhere. Harjap asks who told you that he has a student visa. The woman says he is at Birmingham University. Harjap says this doesn’t mean he has a student visa. She says I don’t know, in this country he is at Uni. Harjap says with the original visa he had, he could still study. She says his visa finished but Harjap says he could have applied earlier. She asks does this mean he could be just waiting in this country then and Harjap says yes. The woman says the guy who told us he has a student visa is his friend. Harjap says but he didn’t show your the visa did he. The woman says she has sent three letters to the immigration. Harjap says they will take action themselves. The woman says he is defending the case and Harjap says he is only doing this to bide some time. She says they say that in 14 years experience, there have been 2 defended cases with Indian boys.Harjap says they are doing this thinking they will get away with it but they don’t. The woman says more money has to be paid. Harjap says there is a cost for the appeals. She says before a wedding, should you do a test and then get married. Harjap says no, you can ask someone back in the pend who knows, someone must know. She says he was a solicitor, it was all calculated. Harjap says when you try to fix up your children, you ask many places, even as far as the grandparents. If we go India, in about 1 to 2 weeks we come back with the wedding done. If you ask someone in India, someone would have told you news. The woman says it didn’t come into my mind. He says if there is a criminal, are you saying the government or authorities won’t know about it. You should have checked yourself. She says if you have a criminal conviction, does that mean you can’t get a student visa. Harjap says yes. She says when his passport was inbounded and he went to pay his fines…. Harjap says when he first got his visa, he lied. The home office will go on this and they can tell his status but won’t give it to you. She says she has sent many letters but only acknowledged one. Harjap says they will not tell you due to the law. She says what about the money spent by me. Harjap says you have to pay that,, the government won’t pay it, you got married to him. She says I will give that but will this illegal get caught as he was on a spouse visa. Harjap says they will do everything themselves, they are not your grandparents.He sniggers and then makes a joke saying she enters saying she is from England and gets married to a solicitor and finds out afterwards.The authorities got enough to deal with, these are your faults. If I and a horse throws up in the street, I tell you do pick it up and you will say I didn’t do it, why should I pick it up. This is the same as this. You brought a criminal into this country, they clear it after you.

Lawyer analyzes DWI news anchor’s felony death charges

Winston-Salem lawyer Clark Dummit analyzed the charges brought against WXII news anchor Tolly Carr on Friday, April 20, 2007. Carr was charged with felony death by motor vehicle for the death of Casey Bokhoven. He was also charged felony serious injury by motor vehicle for the injuries suffered by his passenger and friend Fjola Wilson. Carr was previously charged with DWI (Driving While Impaired).

Casey Bokhoven, age 26, was violently struck and killed by a pickup truck as he stood on a sidewalk waiting for his girlfriend. The truck, driven by WXII (Winston-Salem, NC) morning anchor Tolly Carr,vaulted over a small wall and hit Casey at 30 mph, dragging him 22 feet, hitting a building and coming to rest with Casey under the wheel. The incident occurred Sunday, March 11, 2007 around 3:40 AM. Charged with DWI, Carr admitted he had been drinking and warrants detail that he refused a Breathalizer test. Blood was taken from Carr, and the results of blood-alcohol tests have not yet been released to the public as of this date (April 20, 2007).

I agree that Drinking & Driving don’t mix and if caught, you deserve to pay the penalty, but,,,?

I have a question and I’m curious which option is the better one to take, if you are pulled over and asked to step out of your car and you know that you’ve had too much to drink and most likely intoxicated.

The officer will usually ask you to submit to a breath test? Should you submit or should you refuse and defer all decisions till you have a chance to discuss with an attorney? I’ve heard either way, you will be cuffed and taken down to the police station. I’ve had people tell me, you never “blow” (test).
Please don’t over-react, as I’m just asking the question. I have NEVER been pulled over by a cop, suspecting that I been drinking and I hope it NEVER happens. I’ve been very careful about not getting behind a wheel, after having more than a couple drinks and even if I do drive, I make sure that my couple drinks are seperated by enough time in between and I’m eating something too
i should have re-phrased my question, as I never intended for this to be about what is the RIGHT thing to do. I know the right thing to do is NEVER get behind a wheel and drive if you’ve been drinking.

The question is, in defense of the intoxicated driver, to limit or minimize the legal impact that this potential drunk driver will or may have to face, is it in his/her best interest to do the breath test or just refuse and let the cop take you in and then, consult with your attorney?

DO NOT do anything with out your attorney!!!!!!

Have the officer read your miranda rights, hand cuff you and take you to jail.

NO talking!!!!!

Would it be a good idea to get a lawyer or stick with a pulic defender in this situation?

I am eligible to get a public defender but I am considering hiring a lawyer by borrowing money from a friend because I was arrested inside my house when the police were told they could not come in and I never drove the car, I was arrested because I was drunk and my car was left in the middle of the street by my friend and they came after me.

Did the cops print your steering wheel for prints? Even if they did your prints would be there because you drive the car everyday. Did the cops break into your home or did you leave the door open? DO NOT ever open the door if a cop knocks on it. FIRST RULE !!! If a cop wants to speak to you ever it is never good for you !!!! Any attorney will tell you this that is worth their weight in gold. The public defender I hate to say it isn’t going to be that good. There is no incentive in them being that good even though they mean well. They work for the state CLICK any ideas in your mind the people trying to convict you ??? If they were any good at being attorneys they would be in PRIVATE PRACTICE making the real money. They usually make between $ 36,000 and $ 50,000 dollars a year on salary and work long hours. I mean give them a break they don’t get paid much more than a teacher is they are lucky so don’t expect to get great representation. Especially since their work load is usually loaded down with a huge backlog. Sometimes you get appointed a great attorney whom is obligated by the court to do some public service but these guys really don’t have time for you. I would borrow the money in good faith and repay it to your friend. Seems like he or she really cares about you. I am sure a reputable attorney can get you off this charge or do a plea bargin with the District Attorney before it even has to go to the docket. Most D.A.’s just want a guarantee of some sort even if it is a little community service so that you know NOT TO EVER DRIVE DRUNK. They do it so that you won’t go and kill someone. Just make sure you get deferred adjudication say for 3 to 6 months. If you don’t do anything wrong in that period of time it probably won’t go on your record but I don’t know what state you live in. If you get a DWI it will surely ruin your future in the short run if not forever depending on your career track and responsibilites at work. GOOD LUCK !!!! GET A GREAT ATTORNEY !!!!
