Should I get an attorney for my DUI?

December 14th, 2009

I need dui help. I am 18. My BAC percent was .152. Monroe, Louisiana was where I was arrested.

Either the bail bond guy or the cop that arrested me told me there is no point in getting an attorney ’cause of my situation. But I want to know if that’s true? I really dont wanna lose my license for six months + two years probation, plus the $1000+ fine, and the classes/community service… that is ****. The fine and classes/service sure, but I dont want the license suspension or probation! Please!

Is there any hope at all? I also am charged with speeding 53 in 35 and improper lane use.

Yes, get a lawyer. Having one will do you no harm, and might possibly help you avoid the stiffest penalties for your offenses.

Having said that … most District Attorneys have a real axe to grind for minors in possession of alcohol and/or minor DWI. There are organizations (local, state and national level) that are fighting to prevent any reduction in charges for alcohol related offenses.

With a lawyer, there is a very slim chance that you will not lose your license. Without a lawyer … you have no chance at all of keeping your license on conviction.

Criminal Charge in Virginia Attorney Please Respond?

December 12th, 2009

I’m in a huge dilemma here. I’ll get to my dui arrest in a minute. I was fishing outside of Chesapeake and I had two rock fish that were below the legal limit on my stringer. Here is the problem. I had the department of natural resources I believe?? come up to me and ask me for my fishing license. I did not have one so I attempted to talk my way out of it. He was fine until he saw my stringer. He pulled my stringer from the water and saw 2 rock fish that were not of legal size and apparently out of season. He turned to me to ask my name and my instincts took control and I punched in the face. I jumped in my car and attempted to flee. Unfortunately, I was pulled over by the cops about a mile down the road. The big problem is I was intoxicated and arrested for assault and battery, fishing without a license, fishing out of season, resisting arrest and driving drunk. Furthermore, when I arrived at the police station I spit on an officer. I need some serious advice pleaseeee. This is not a joke - just give me names!!! Thank you!

Wow, you are in a heap of trouble. Not only do you have the state charge of DWI but also the charge against fishing out of season.
What were you thinking? Virginia has a pretty strict law on Drunk Driving , but pretty lax on dnr infractions. I don’t care about a couple of undersized Rockfish, they are only fish by the way, that’s all.
Get a criminal defense lawyer now. Check out there websites for dwi, resisting arrest, fishing violations, and trespassing. Go to targetlaw.com and a search for Virginia Criminal Lawyer.

I just got a DUI, will that stop me from getting a gun?

December 12th, 2009

I’ve heard it it both ways-I just kind of want to know (and no, it hasn’t gone on my record yet):

Oh, and the first person to lecture me about the dangers of drinking and driving can choke on a safety pin!
The dui arrest was the first and last time I’ll ever do something that stupid, I blacked out and woke up in the hospital. The reason I told people to choke on a safety pin is because I’ve already gotten my lectures. It was dumb, and I will NEVER do anything so stupid ever again. I thank God no one was hurt and have been donating every spare penny I have to anti-drunk driving charities. Oh, I’m in CO.
Oh, and the reason I want a gun is because my house was broken into recently and the only thing I had at my disposal was my grandpa’s old service knife. I was scared and never want to feel that way again.

Many good answers..it depends.

A felony DUI kills your chance of ownership, if convicted – period.

Conditions following a non-felony DUI may prohibit ownership until all legal conditions are satisfied.

Are there any free sites to check if someone had a DUI arrest?

December 12th, 2009

Are there any free sites to check if someone had dui arrests? The ones I looked at all charge a fee. I was wondering if any local or government site would have this info as it is usually printed in the newspaper and public record. Thanks!!!

I’m required to run background checks on people before I hire them and I do it for free. I go to two sites from anywhere that person has lived.
I go to the local County Municipal Court and do a Docket Search on them, that will usually give you not just criminal arrests but also civil cases they’ve been involved in. The County Municipal Court site tells me when they were arrested, why, and what the outcome was (fine, jail, etc.)
I also check the web site for the local county jail and search under past inmates.
Most counties Municipal Court sites, jail sites, and even states corrections sites offer up this information for free requiring nothing more than the persons name. Good luck.

Marijuana DUI Victim

December 12th, 2009

Update: All charges related to marijuana and the dui arrest against Scott have been dropped by the courts although Scott did pay a fine for making an illegal right turn. Medical Marijuana activist Scott Bledsoe filed a lawsuit against San Bernardino County to force them to implement the MMJ ID card program. The next day when he was going home he was followed by San Bernardino city police and arrested for DUI. This video tells the story at a meeting of the High Desert MAPP in Landers California.

Do you think it’s fair that police arrest others for DUI & DWI when they do it themselves?

December 11th, 2009

Do you think it’s fair that police arrest others for DUI & DWI when they do it themselves? To me that’s hypocritical, and it goes on here in NJ nonstop! Are they above the law?

No, it’s not fair. I agree that it is hypocritical. It goes on not only in NJ but all 50 states and is referred to as ” professional courtesy.”

No one (should) be above the law.

DWI news anchor asks for money, support. No tears for victim

December 10th, 2009

Go to myspace.com/ncproud for more about Casey Bokhoven

WXII Tolly Carr speaks at church about the preliminary dwi accident report.

Tolly Carr’s lawyer, David Freedman, presented the media with a DVD containing video of Carr speaking at Greater Cleveland Avenue Christian, a local Winston-Salem church, just a week (Sunday, March 18, 2007) after the fatal accident. Carr appeared to focus more on the affect his DWI accident had on his career and his own family than on the man whose life he took, Casey Bokhoven. He did not mention Bokhoven by name, but asked the church congregation to pray for the victim’s family.

Also, a preliminary accident report was released, with these details of the accident in which Tolly Carr was involved: Carr went through the work zone barricade at Burke and West First Street at around 50 mph in his Ford 150 pickup truck, preceded down West First Street, veered off the road, went over a small wall, hit Bokhoven at 30 mph as he was standing on the sidewalk, then drug him 22 feet before crashing into a building. Bokhoven died under Carr’s pickup truck.

Carr has been charged with DWI thus far, with more charges possible. Carr refused a Breathalizer test and was unable to perform simple field sobriety tests at the scene. Blood samples were taken and the results have not been released to the public as of this date. (March 25, 2007)

This was from Fox 8 WGHP 10 pm broadcast on Friday, March 23, 2007. WGHP is located in High Point, North Carolina.

Could I get my security clearance revoked if I have a DUI and recently arrested for domestic violence?

December 9th, 2009

Two years ago I had a dui arrest and plead guilty to BAC over .08%. I was also arrested for domestic violence but I will most likely plead guilty to Disturbing the Peace. What are the chances that I will get my secret security clearance revoked? If I take the domestic violence case to trial and am found innocent, what are my chances then?

Oh, yes. What else do you expect??
