Los Angeles Drunk Driving Lawyers :: Breathalyzer 101

December 8th, 2009

losangelesduiexpert.com/ 888.400.9721. There are two types of breathalysers normally used in a Los Angeles, California, or Orange County, California dwi or dui arrest. First, at the roadside, the cops will ask you to submit to a blow test. The police officer or highway patrolman (CHP) will have you blow into a sanitary tube and into a little machine. The machine can make beeping noises and spit out a chemical analysis of your blood alcohol levels.

Police use this as a tool to help determine if you are ok to drive, in addition to the normal field sobriety test (FST). The next DUI machine that tests your breath will be at the police station. That is the more accurate test. If you were arrested for drunk driving in Los Angeles or Orange County, and want to know more about your legal rights call Ehline Law, Los Angeles DUI lawyers. hey is me again, oh …
hey is me again, oh one more thing,In every criminal trial, the prosecution must prove the corpus delecti, or the body of the crime itself-i.e., the fact of injury, loss or harm, and the existence of a criminal agency as its cause.” People v. Sapp, 73 P.3d 433, 467 (Cal. 2003) [quoting People v. Alvarez, (2002) 27 Cal.4th 1161, 1168-1169, 119 Cal.Rptr.2d 903, 46 P.3d 372.]. it bet you they did not teach you in school about corpus delicti.

    False. State and …
False. State and businesses are deemed persons and human beings are also “persons” the state is an incorporeal person.

  10. mrcow1985 Says:

    okay what ever the …
okay what ever the state is not a person. okay let me school you again. black law dictionary. person: A human being. – Also term natural person. looked it up for your self. civil code 1708 clearly says person not state. so you must be a freemason aka satanist sellouts that loves power and selling out people.

  11. injurylawyers Says:

    they can choose to …
they can choose to plea nothing and refuse.

  12. injurylawyers Says:

    your point? the …
your point? the state is a person. civil code sec 1708 was written by sell outs. why do you pick and choose?

  13. mrcow1985 Says:

oh in the black law …
oh in the black law dictonary victim means a person:a person harmed by a crime, tort,or other wrong. i do not see a state being a victim at all. oh by they way look at civil code 1708:Every person is bound, without contract, to abstain from
injuring the person or property of another, or infringing upon any of
    his or her rights.

  14. injurylawyers Says:

    yeah good luck dude …
yeah good luck dude. I was a member of Our One Supreme Court too. It is all bunk. 14th Amendment? Are you joking. You hide behind statutory inventions that turned rights into privileges and yet when convenient, call yourself a man upon the land.

  15. mrcow1985 Says:

    look you moron the …
look you moron the state is not a person, a 5 year knows that, for example traffic tickets are not vaild cause of action you retard, unless the cop can proof that i injured a person, damage someone property or steal someone property. i bet you are a freemason.

  16. mrcow1985 Says:

    i knew it you are a …
i knew it you are a sale out, driving is commerce you sale out,you do not need a driver license to travel unless you are getting paid, read the 5 amendment of the u.s constitution and the 14 amendment of the u.s constitution buddy. by the way you guys are in volation in anti trust act. i might be a college drop out living in the inner city but i do my homework, you should research charlie sprinkle the true patriot that has not have a driver license for 35 years and he is way better than lawyers.

  17. mrcow1985 Says:

    oh one more thing …
oh one more thing stop selling out your clients you should know that if they plea guilty, not guilty or not contest they are contract of the court, and first of all,the prosecutor has to have a valid cause of action against the defendent in order to convicted the defendent of a non violent crime like drugs and dui.

  18. injurylawyers Says:

    Yeah you can tell …
Yeah you can tell the cops and all of us that when you are in jail. You can travel all you want. but when you get in a car, you are “driving”

That makes you subject to the easement the state has upon the roads.

  19. injurylawyers Says:

    Sounds like more of …
Sounds like more of that patriot movement crap. Dont work. The victim is the state. When you drive you enter into a contract with the DMV. If a cop smells booze and you are nailed on the breath test, by contract you abrogated your rights and there is a victim due to your breach of contract.

  20. mrcow1985 Says:

    u are a tyrant, …
u are a tyrant, because you enforce bad laws, cops do not know the law they are tyrants all the way.

  21. mrcow1985 Says:

    first of all …
first of all driving is commercial. travel is when u travel for pleasure. have u taught about defending clients on right to travel vs driver license. i am not a lawyer at all but i do studied the law alot and basically, dui laws is not law because the system wants to take people to jail for no reason unless they hurt some one. under duress

  22. mrcow1985 Says:

yeah to beat a dui …
yeah to beat a dui a corpus delicti must be presented. for example the judge can not put u in jail unless the drunk driver hurts a person and the person have to file a criminal complant. like they always say no victim no crime can u explain what i am trying to say. a corpus delicti:injury, lost or harm.

As a DUI cop I will agree that sometimes officers make mistakes. But when the DUI is cut and dry, why pay an attorney 7 grand to foght somethign you will probably lose. And even if you don’t lose, you still have to pay.
